What should you confirm with the court?
Does a small estate limit confirm eligibility?
No. The property measure, date of death, debts, other proceedings and the person applying can change the answer. Read every procedure and its source. The court decides what it accepts. Talk with a lawyer in your state about legal questions.
Which property may pass outside probate?
California and Oregon court guidance describes qualifying survivorship ownership, named-beneficiary or transfer-on-death accounts, and property titled to a living trust. These examples depend on state law, valid ownership and designations. Talk with a lawyer in your state.
Can the checker choose or complete the form?
No. It describes the procedures and links official forms or instructions. Read the full court requirements. A form link is a reference, not a choice or a completed legal document.
Does real property rule out every small estate procedure?
Read each procedure separately. A personal-property procedure cannot transfer land. That does not establish whether the same estate can use it for personal property. Separate real-property procedures and conditions appear where verified.
When should you return?
Return when the property list, ownership or court instructions change, and before relying on a limit. We recheck sources every quarter and sweep legislation from January through July. Calendar downloads are voluntary review checkpoints. Confirm court hours separately.
How does this tool work?
- 1What it does
Compare official small estate procedures, dollar limits, property measures, waiting periods and form links for every state and DC.
- 2How it decides
Choose a state and read each procedure separately. Match your figure to its quoted property measure before comparing a limit. The checker does not value property, subtract exclusions or combine separate baskets. It compares stated limits and death-based waiting periods only when those fields are verified. Every other condition remains unresolved. Planning mode describes property types without recommending a legal strategy. Calendar dates are voluntary review checkpoints, not filing deadlines. We do not adjust them for weekends or holidays.
- 3Your answers
Your answers stay in this browser. Anonymous tool-use counts contain no answers. A copied link includes your answers in its fragment. Share links and downloads only with people you choose.
- 4What it is based on
The table links the legislature statute text and state-court guidance used for each rule. California court guidance and Oregon court instructions supply state-scoped planning illustrations. Quoted property measures stay unchanged. We recheck sources every quarter and sweep legislation from January through July. We recheck each official source at least once a year and update this page when one changes.
- 5What it doesn't do
This comparison cannot establish legal eligibility, select a form, resolve creditor claims or confirm the law for a historical death. Current text and explicitly stated death-date branches remain separate. Unknown cells say Not published and link the court or legislature. The official source may change before the next review.
